IN CONSIDERATION of being allowed any stabling accommodation I AGREE:

1) That any and all substitutions or conditions of the horses named herein this Stall Application must be approved by Sudbury Downs prior to date of shipping.

2) That as when, from time to time, any horses occupying the said stabling accommodation are dropped from training or another horse is to be raced at the meeting in progress, I will immediately inform Sudbury Downs, giving the names of any such horses.

3) That Sudbury Downs shall not jointly or severally be liable or responsible for any loss or injury suffered by me or any person in my employ or under my control or charge or for any loss of or injury to horses, sulkies, or other personal property belonging to or in the possession or control of the undersigned occurring in any manner whatsoever on the premises known as Sudbury Downs in the Regional Municipality of Sudbury whether caused by fire, the condition of the premises, the negligence of Sudbury Downs or in any manner whatsoever.

4) To indemnify Sudbury Downs and any other person or persons against any costs, legal fees, loss or damage caused by a horse or horses or by the personal property belonging to or in the possession or control of the person who has signed this Stall Application while on or being transferred to or from Sudbury Downs. And to indemnify Sudbury Downs from any and all claims in respect of injury or death of my employees or any of them while on the said premises of Sudbury Downs.

5) That this privilege of stabling accommodation may be revoked and terminated by Sudbury Downs at any time without notice.

6) To abide by and be governed by the rules, regulations and directives of The Ontario Racing Commission, Standardbred Canada, the Canadian Pari Mutuel Agency and Sudbury Downs.

7) I agree to remove my horses and/or those in my possession, charge or control together with all personal property belonging to me, or of which I have possession, charge or control from the grounds of Sudbury Downs forthwith upon the expiration of twenty four (24) hours after Sudbury Downs has given me notice to vacate the stabling accommodation, which notice may be given in the absolute discretion of Sudbury Downs without any reason or cause existing or being stated or given; any such notice or any other notice given hereunder shall be sufficiently given by posting up such notice on some portion of the stabling accommodation allotted to me and such notice shall be deemed to be given at the time when the same is posted up. I undertake that my employees shall leave the premises of Sudbury Downs forthwith upon the expiration of the said twenty four (24) hours notice. I agree that if upon the expiration of the said twenty four (24) hours notice herein before mentioned, any horse or horses or personal property belonging to me or in my possession, charge or control, have not been removed from the said Sudbury Downs premises Sudbury Downs shall be entitled to remove the same from the said premises without further notice, either to a public pound or Sudbury Downs may stable the same at my expense elsewhere, and Sudbury Downs shall not in any event, either jointly or severally be responsible for any such horses removed as aforesaid.

8) No heating apparatus or electrical wiring shall be installed in the stabling accommodation allotted to me without the prior written approval of Sudbury Downs.

9) It is understood that Sudbury Downs reserves the right at any time to deny admission to the said Sudbury Downs premises to me or my employees.

10) I agree to have available at all times for inspection by Sudbury Downs, all horses in my stable, in my charge or control on the premises of Sudbury Downs for the purpose of identifying each by the reading of their lip tattoo or neck branding.

11) To be responsible for the conduct of each and every one of my employees and/or any person or persons in my charge or control on the Sudbury Downs premises.

12) I agree not to mutilate or in any way damage the accommodation allotted to me and further that I will not make or permit to be made any structural changes in the said stabling accommodation; I agree to be responsible for all damage to the stabling accommodation allotted to me during the subsistence of this agreement; I agree to keep such stabling accommodation in good and clean condition and deposit the manure and litter where directed by Sudbury Downs.

13) I agree not to boycott racing at Sudbury Downs and further confirm my support of racing at Sudbury Downs by agreeing to enter my horses in a normal fashion, consistent with racing on a permanent basis.
